Freedom of Information Act (FOIA), 5 U.S.C. § 552. Any person has a right to access records of any federal agency, except for those documents that are exempt from disclosure by one of nine specific exemptions. NLRB v. Sears, Roebuck & Co., 421 U.S. 132, 136 (1975).
FOIA establishes the right to request records and to receive a response to the request. Pursuant to 5 USC §552(a)(6)(A)(i), within 20 days you should receive acknowledgment that the agency received your request. If a record cannot be released, you are entitled to be formally advised of the reason for the denial. You also have a right to appeal the denial and, if necessary, to challenge it in court. Access to information of the U.S. federal government can no longer be controlled by arbitrary or unreviewable actions of hidden bureaucrats.

FOIA rules:

Any time you speak with agency personnel on the telephone, get the name of that person. Make sure they know you are writing it down (e.g., ask for proper spellings, record the date and time of your conversation, etc.).

After you speak with agency personnel on the telephone, send a quick letter that documents the points covered. Ask that he or she inform you immediately in writing if your recollection of the conversation is incorrect.

Make copies of all correspondence (both sides) regarding your request. Hang onto these copies. You may need them.

Ask for the information you want before you invoke the FOIA. If the requested information is denied, cite the FOIA and make sure your records are adequate for review at the next level as afforded by FOIA. An argumentative posture tarnishes the administrative record needed to win on appeal.

Be prepared to wait. Give the agency the benefit of the doubt the first time you encounter a problem with your request. Work with the agency to facilitate resolution of the problem. If you continue to encounter resistance, the real obstacle may be intentional agency opposition to disclosure so do everything you can to make a good record for review.

The most recent amendments to the Act are via The Electronic Freedom of Information Act Amendments of 1996. "Government agencies should use new technology to enhance public access to agency records and information." See P.L. No. 104-231, 101 Stat. 2422, Sec. 2(a)(1996). You may now get information from an agency website, avoiding a written FOIA request. Not all agencies have complied yet with these mandates required by law. :Source; Links.

HRS: §92F-3 General definitions. Unless the context otherwise requires, in this chapter:
"Agency" means any unit of government in this State, any county, or any combination of counties; department; institution; board; commission; district; council; bureau; office; governing authority; other instrumentality of state or county government; or corporation or other establishment owned, operated, or managed by or on behalf of this State or any county, but does not include the nonadministrative functions of the courts of this State.
"Government record" means information maintained by an agency in written, auditory, visual, electronic, or other physical form.
"Individual" means a natural person. [:Note: with the use of the word: "person" as a verb for the lack of any meaning in the truth.]
"Person" means an individual, corporation, government, or governmental subdivision or agency, business trust, estate, trust, partnership, association, or any other legal entity.
"Personal record" means any item, collection, or grouping of information about an individual that is maintained by an agency. It includes, but is not limited to, the individual's education, financial, medical, or employment history, or items that contain or make reference to the individual's name, identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph. "Court Rules / Orders / Policy Statements:
No active or proposed rules or policies at this time related to public access to electronic court records. The only exception is the current policy which prohibits non-criminal justice agency access to computer systems (for technical security reasons).
Remarks:
At this time the Hawaii judiciary does not provide any external (i.e., non-criminal justice agency) access to electronic court records. Several of the jurisdictions do provide a terminal, accessible by the public for inquiry purposes; these terminals provide access only to non-confidential electronic case records.
The Hawaii judiciary has not studied the issues surrounding public access to electronic court records in depth. The topic has been raised quite a bit, however, over the last several years, especially in light of Hawaii’s public records law (cited above). The major technical concern with granting immediate access to the systems is the courts’ inability to provide adequate security to the electronic records to prevent tampering or destruction of those records. The systems currently in design will provide the necessary accommodations for public access to selected portions of the court databases.
